pursuant to art. 13 Italian Legislative Decree 196/2003 - Personal Data Protection
Code.
In compliance with Italian Legislative Decree no. 196/2003
(privacy code), we hereby wish to inform you that any data we acquire concerning
you shall be processed according to the following conditions:
- Purposes and methods of processing the data
The data will be processed in relation to contract requirements
and for the purpose of fulfilling the ensuing legal and contractual obligations,
as well as to achieve effective management of commercial relationships.
The data will be processed throughout
the duration of the contract and thereafter for the purpose of fulfilling all
of the requirements established by law as well as for future commercial purposes.
In addition to being collected, the data may be recorded,
stored, modified, communicated, erased and disseminated, etc., and may also
be processed by electronic and/or automated means, in which case suitable methods
and tools will be used to assure the security and confidentiality of the data
themselves. Specifically, all of the technical, informational, organizational,
logistics and procedural security measures specified in Legislative Decree 196/03
shall be adopted. Furthermore, the methods applied guarantee that access to
the data will be permitted only to the persons our Company has placed in charge
of the processing.
- Provision of data.
Your providing the data and consent to the processing
thereof is essential in order that we may correctly start up and continue a
relationship with you. Your refusal to provide the aforesaid data may make it
impossible for Ducati Sistemi to initiate or suspend contractual relationships.
- Communication and dissemination
of data.
The personal data you provide or
which are acquired by us in the course of our contractual relations may be communicated
to public and private entities, natural and/or legal persons having purposes
of a commercial nature and/or related to management of information systems and/or
systems of payment, including external entities assigned to perform specific
tasks on behalf of our Company.
More specifically, the data may
be communicated to the following categories of entities: sales network, banks
and credit institutions within the scope of the Company’s financial management
needs, law firms, independent auditors and administrative, tax and contract
consultants, insurance companies and fraud control and debt collection agencies
or professional associations, tax authorities, social security institutions,
law enforcement agencies, transport companies or other entities for supply-related
services.
They may also be communicated to
other companies in our group, based in Italy and abroad, for the purpose of
coordinating operations.
- Rights of the data subject
Under art. 7 of Legislative Decree
no. 196/2003, you have the right, among other things:
1. to obtain confirmation as to
whether or not personal data concerning you exist, regardless of their being
already recorded, and communication of such data in intelligible form.
2. to be informed
a) of the source of your personal
data;
b) of the purposes and methods
of the processing;
c) of the logic applied to the
processing, if the latter is carried out with the help of electronic means;
d) of the identification data concerning
data controller, data processors and any representative designated by a foreign
entity to process data in Italy;
e) of the entities or categories
of entities to whom or which the personal data may be communicated and who or
which may become acquainted with said data in their capacity as designated representative
within the territory of Italy, data processors or persons in charge of the processing.
3) to obtain:
a) updating, rectification or,
where interested therein, completion of the data;
b) erasure, anonymization or blocking
of data that have been processed unlawfully, including data whose retention
is unnecessary for the purposes for which they have been collected or subsequently
processed;
c) certification to the effect that the
operations as per letters a) and b) have been reported, also as relates to their
contents, to the entities to whom or which the data were communicated or disseminated,
unless this requirement proves impossible or involves a manifestly disproportionate
effort compared with the right that is to be protected.
4. to object, in whole or in part:
a) on legitimate grounds, to the
processing of personal data concerning you, even if they are relevant to the
purpose of the collection;
b) to the processing of personal
data concerning you, where it is carried out for the purpose of sending advertising
materials or direct selling, or for the performance of market or commercial
communication surveys.
The above rights may be exercised either directly or
through a person or entity appointed by you, according to the provisions of
art. 8 and art. 9 of Legislative Decree 196/2003.
